By accessing or using Bunny Trail ("the Service"), operated by Blue Fermion, LLC ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
You must be at least 13 years old to create an account or use Bunny Trail independently. Children under 13 may only participate under the direct, in-person supervision of a parent or legal guardian at all times. Parents and guardians who permit minors to use the Service accept full responsibility for the minor's safety, conduct, and compliance with these Terms.
Bunny Trail is a GPS-powered outdoor treasure hunt platform. Gameplay requires physical movement outdoors. Like any outdoor activity — hiking, biking, or playing in a park — participation carries inherent physical risks including but not limited to trips, falls, exposure to weather, traffic hazards, uneven terrain, and encounters with wildlife. You acknowledge these risks and participate voluntarily.
If you create trails as an Organizer ("Author"), you accept additional responsibilities:
By using Bunny Trail, you voluntarily assume all risks associated with outdoor physical activity. You acknowledge that the Service involves walking, running, and navigating outdoor environments, and that such activities carry inherent risks of injury, property damage, or other harm. You agree that you participate at your own risk.
Your use of the Service is subject to our Privacy Policy. Location data is collected only during active gameplay and is not stored permanently.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that GPS coordinates will be accurate.
To the maximum extent permitted by applicable law, Blue Fermion, LLC, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to personal injury, property damage, lost profits, or data loss — arising from or related to your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or $50.00, whichever is greater.
You agree to indemnify, defend, and hold harmless Blue Fermion, LLC from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or any injury or damage caused to any third party in connection with your use of the Service or your role as a trail organizer.
Parents and legal guardians are responsible for supervising their children's use of the Service. By allowing a minor to participate, the parent or guardian agrees to these Terms on the minor's behalf and accepts responsibility for the minor's safety and conduct. We strongly recommend that parents accompany children during gameplay. See our Parent Guide for setup instructions.
We may revise these Terms at any time by updating this page. Material changes will be indicated by updating the "Last updated" date. Your continued use after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in San Diego County, California.
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
